美国专利律师对质量与数量现状的反思, 供国内业界特别是企业专利决策人参考

今天提到专利申请的费用问题, 我的美国同行提到, “I think [bargaining] in patent prosecution fees is pretty disturbing, particularly in light of the fact that clients still seem willing to spend $5M – $10M on patent litigation. It really doesn’t make sense that the world of clients and potential clients want quickly done cheap patents and then expects them to stand up to thousands of hours of scrutiny in litigation. Over the years, I’ve suggested to several clients that they should have me spend twice as much time as they’ve budgeted for per patent application, but file only half the applications they were planning on. One client actually took me up on this, and it’s worked out pretty well for their IP portfolio!”

大意是,“目前客户和企业在专利申请的费用上过于计较让人不安, 特别是考虑到这些公司动辄花费五百万到一千万在专利诉讼上。 这些公司在专利申请的费用上过于计较却希望这些专利日后在若干专利诉讼律师花费几千小时鸡蛋里挑骨头的过程中经得起挑战。 我执业的过程中, 经常建议客户要准备花费高于预算一倍的费用在每件专利申请中, 但是只申请预计的一半数量的专利。 我的客户采纳了我的建议, 结果客户的专利资产非常合理和健康!”

我回答我的美国同事, “如果我是企业的负责人, 我也一定采纳你的建议, 因为一件有用的经得起诉讼考验的专利胜过几千件无用的或经不起考验的专利!”

实际上,我对中国企业还有一条建议是, 与其一年在中国申请5000件专利, 只在美国等国家申请5-10件专利, 不如省下费用, 在中国申请500件强有力的专利, 在其他每个主要市场国家申请至少50件专利, 获得真正地、强有力的全球性保护和提升企业竞争力!
